Binances EU services face scrutiny over licensing exemption: Report

European regulators are reportedly scrutinizing Binance‘s use of a legal exemption to continue serving customers in the European Union without authorization under the bloc’s crypto rules. The European Securities and Markets Authority (ESMA) and regulators in France, Germany and Greece are examining Binances use of reverse solicitation under the Markets in Crypto-Assets Regulation (MiCA), the Financial Times reported on Thursday. Binance withdrew its Greek MiCA application in June and said it would seek authorization in another EU member state. Binance told Cointelegraph on Sept. 18 that it continues pursuing MiCA authorization and remains committed to operating in Europe on a long-term compliant basis. Reverse solicitation under scrutiny Binance is relying on reverse solicitation to continue serving some EU customers, the report said, citing a person familiar with the matter. The exemption allows non-EU crypto asset service providers (CASPs) to serve customers who approach them entirely on their own initiative, but ESMAs guidelines stress that companies cannot use it to circumvent MiCA requirements. Related: Binance disappears from Google Play in certain EU countries Ahead of the end of MiCA‘s transitional period on July 1, Binance told Cointelegraph that EU access would depend partly on a user’s jurisdiction, account status and “servicing entity.” Some EU traders are now being served

Evernorth clears shareholder vote ahead of Nasdaq debut with 473M XRP treasury

Evernorth is set to become a publicly traded XRP treasury company after shareholders of blank-check firm Armada Acquisition Corp. II approved their proposed business combination. The deal is expected to close on Oct. 7, with shares of the combined company set to begin trading on Nasdaq under the ticker XRPN the following day, subject to remaining closing conditions. The vote clears a key hurdle after Evernorth filed its Form S-4 registration statement with the US Securities and Exchange Commission in March. The registration statement was declared effective in August, leaving shareholder approval as one of the remaining steps before the Nasdaq listing. At closing, Evernorth expects to hold about 473 million XRP, which it says would make it the largest publicly traded pure-play XRP treasury company. According to Thursday‘s announcement, the transaction is expected to raise about $300 million in gross cash proceeds, including $225 million from related private placements, $30 million in convertible note financing and roughly $48 million from Armada II’s trust. Investors have also contributed XRP directly to the transaction. XRP was trading at about $1.50 at the time of publication, according to CoinGecko data, putting Evernorths expected 473 million-token treasury at roughly $710 million. SEC proposes new crypto custody rules for investment advisers and funds

According to the 760-page proposal, the SEC will allow for self-custody by advisers seeking to hold their clients funds. The agency is using the term “self-custody” as an asset management firm practice, not how crypto companies typically use the term. It would first require that an adviser cant find a qualified custodian ready to take the assets, which would likely be an unusual circumstance after the rule is implemented, and it also requires certain expertise for the investment firm to hold crypto assets. Additionally, that ability to hold their own clients assets would have to be reviewed every quarter to see if a custodian has become available, an SEC official said. The official granted that the circumstance for self-custody — which stems from an industry request to the Crypto Task Force — would likely be unusual, though it could apply to a newly launched token that custodians didnt yet support. Atkins said that existing custody rules “were designed to protect the assets of advisory clients and regulated funds from loss, theft, misuse, and misappropriation,” but they only consider “the custody and safekeeping only of traditional assets — an untenable situation in the 21st century.” The newly proposed rule, open for a 60-day public

African businesses turn to stablecoins to cut payment delays, Kora CEO says

African businesses have increasingly turned to stablecoins over the past five years to address cross-border payment delays, dollar access, and settlement costs, according to Kora CEO Dickson Nsofor. Dickson Nsofor, CEO of pan-African payment infrastructure platform Kora, told crypto.news that businesses increasingly see stablecoins as a way to resolve payment problems that have complicated trade across African markets. Drawing on his experience building the company and working with merchants, he identified commercial payments, supplier settlements and cross-border payouts as areas of growing demand. In his account, interest is strongest where businesses face slow transfers, high costs, or difficulty obtaining liquidity. Stablecoins address supplier payment delays and dollar access Before founding Kora, Nsofor ran a hardware business in Nigeria, where paying a manufacturer in China could take 10 to 14 days, he recalled. Transfers passed through several correspondent banks, and an error could extend the wait. For companies trying to trade or expand into another market, he said, receiving and settling money efficiently comes before other financial activity. “They are solving a practical problem first. Businesses are seeing a way to move and settle value across borders more efficiently, and that creates the foundation for other financial activity.” According to the payments executive, stablecoins can provide a dollar-based
